B&E NIGHTTIME FOR FELONY c266 S16
|
CENTRAL SQ
Cambridge Police responded to Green Street and Magazine Street in regards to a breaking and entering in progress. Upon arrival, officers observed a black male suspect (carrying a full trash bag) walking away from a convenience store that had apparently just been broken into. Officers attempted to stop this suspect (later identified as one of the defendants, Athen Whigham, 61, 39 Boylston Street in Boston). Whigham dropped the trash bag (which contained $473 in cash/coins, 15 cartons of cigarettes, and 47 individual packs of cigarettes - the stolen cigarettes are worth approximately $2,167) and fled on foot. Officers spoke with a witness, who observed a second suspect (later identified as the other defendant, Jose Torres, 58, homeless) flee into a nearby alley. Officers located Torres in the alley. Officers then noticed that the initial black male suspect had returned to the scene, at which point he was detained. Officers recognized him as the suspect who dropped the trash bag and ran away from them earlier. Additionally, a witness positively identified Whigham as one of the suspects who broke into the convenience store. Officers viewed surveillance video of the breaking and entering and were able to confirm that Whigham and Torres broke into the convenience store. Officers determined that Whigham and Torres actually broke into the convenience store two separate times this evening, approximately one hour apart each time. Whigham and Torres were subsequently placed under arrest. Whigham is being charged with two counts of Breaking and Entering Nighttime for Felony. Torres is being charged with two counts of Breaking and Entering Nighttime for Felony, Possession Class A Drug, Possession to Distribute Class A Drug, and Public Consumption of Marijuana. Officers discovered seven individually folded paper bags of heroin on Torres' person.
