Officers located the offending vehicle stopped in the right turn lane at the traffic light on Binney Street at Fulkerson Street. An officer in a marked patrol unit drove past the offending vehicle and observed a large item hanging from the rearview mirror. The operator was also watching what appeared to be a video on his cell phone which was mounted on the center dash. The officer then turned around and positioned his marked unit behind the offending vehicle and activated his overhead lights in order to effect a motor vehicle stop for impeded operation. At this point, the traffic light changed to green and the offending vehicle made a left turn from the right turn only lane onto Fulkerson Street. The officer followed the vehicle with lights and sirens activated as it continued on Fulkerson Street. The vehicle then turned onto Rogers Street and continued towards Sixth Street. It should be noted that the driver was observed making a furtive movement towards the center of the vehicle as it traveled on Rogers Street. The vehicle finally stopped as it reached the Cambridge Police Station on the corner of Rogers and Sixth Street. Officers cautiously approached and made contact with the driver who was identified as Victor Tobar-Jimenez, 41, 10 Lamson Court in East Boston. Officers observed 12 full bottles and one empty bottle of beer on the floorboard of the rear seat through a partially opened rear window. Tobar-Jimenez admitted to having consumed 2 beers. After administering standardized field sobriety tests and Tobar-Jimenez performed poorly, he was taken into custody and charged with OUI-Liquor, Marked Lanes Violation, No Possession of a License, Drinking Alcohol in a Motor Vehicle from an Open Container, and Unsafe Operation of a Motor Vehicle.
