NOTICE OF VOTE:
STRIKING/REVOKING OF HALF PAYMENT OF ALCOHOL RENEWAL LICENSE FEE POLICY OF 2/8/17
On February 8, 2017, the Board of License Commissioners (the “Board”) voted to implement the following:
The Board will only permit alcohol licensees who have a liquor licenses that is not in use to pay half of the renewal alcohol license fee in November and the other half in June. Any alcohol license that is not in use or is in “inactive status,” at the time of renewals, must pay the full renewal fee when renewing in November.
On November 1, 2017, the Board revoked/struck this policy. Specifically, the Board noted that the adoption of the policy, pre-dated a legal opinion from the City Solicitor dated June 14, 2017. Due to the legal opinion, the above-policy was not implemented or ever put in practice. However, the Board had not made the declaration on the record. Therefore, on November 1, 2017, during its open meeting, the Board officially struck/revoked the policy.
In accordance with the City Solicitor’s opinion, G. L. c. 138, §§ 16A and 70, and the Special Acts of 1982 Chapter 397, any alcohol licensee renewing its liquor license can pay the full amount or half of the amount of the alcohol license renewal fee in November. Licensees who choose to pay half of the amount in November, must pay the other half in June to properly renew the license in accordance with G. L. c. 138, §§ 16A and 70.
